Long Term Care Planning

Planning for long term care is not the easiest thing to do, not least because the rules relating to long term care differ between Scotland and the rest of the UK. There is further differentiation between the allowances for people seeking nursing care and residential care. Add to that the ever changing tax and benefits rules!

The HMRC website provides a very comprehensive and easy to understand guide to the most up to date allowances. Once you have an understanding of how the allowances affect you, the next port of call would be your local authority and your local Primary Care Trusts as they in turn have their own policy based on their budgetary constraints.

For the 2012/13 tax year the first £14,250 is fully discarded for nursing care and fees will be paid for by the state. Above £23,250 all nursing fees will have to be met until your funds have diminished.

So you see that careful consideration must be given to planning your finances. Generally clients express two concerns, firstly their ability to afford long term care and secondly that the cost of long term care will deplete their life's work leaving nothing for their families.

We will work to create a plan that is best suited to you. It is better to plan for long term care well in advance of you needing that care. However, it is more common for us to help where you are dealing with the affairs of a family member who has suddenly become in need of care.

These are some of the things you should give thought to when considering your Long term care planning.

  • Your will; is it up to date, to whom and how your estate will be passed on?
  • Your home; how do you own it, a common tenancy or tenants in common?
  • Is anyone dependant on you, how will they be affected if you had to go into care?
  • How do you hold your investments, ready to provide care or with inheritance tax in mind?
  • How will your local authority treat you home if you go into care?
  • What are the cost, quality and availability of care in your area?
  • The Deliberate deprivation rules!
